RenewedSpirit Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RenewedSpirit mobile application, the marketing website at renewedspirit.app, and related services (collectively, the "Service") provided by Mullins Worldwide LLC ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

RenewedSpirit is a mobile application, with a companion marketing website, designed to help users process anxiety and shame through daily check-ins, Scripture-based reflection, prayer prompts, AI-assisted conversation ("Pour It Out"), and audio Scripture content. The Service is intended for personal, spiritual, and emotional support purposes.

2. Important Disclaimers – Not Medical or Therapeutic Advice

READ CAREFULLY:

  • The Service is not a substitute for professional medical, psychiatric, psychological, or therapeutic care.
  • We are not licensed mental health professionals. The App, including AI-generated responses in "Pour It Out," does not constitute therapy, counseling, medical advice, or treatment.
  • AI responses are generated by artificial intelligence and may contain inaccuracies, hallucinations, or inappropriate suggestions. You should not rely on them as professional advice.
  • The Service does not monitor your messages for emergencies and cannot summon help. No one is alerted if you express thoughts of self-harm.
  • If you are experiencing a mental health crisis, thoughts of suicide or self-harm, or severe distress, stop using the Service and get help immediately. In the United States, call or text 988 (Suicide & Crisis Lifeline) or dial 911. Outside the United States, contact your local emergency number or crisis line.
  • The Service is intended to complement, not replace, professional mental health care and pastoral support.

By using the Service, you acknowledge and accept these limitations.

3. User Accounts

  • You must be at least 13 years old (or the applicable age of digital consent) to use the Service.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate information and keep it updated.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

  • Certain features (including full access to "Pour It Out") require a paid subscription.
  • Subscriptions are billed in advance on a recurring basis (monthly or annually) through the Apple App Store or Google Play Store. The length of the subscription period and the price are shown to you before you purchase.
  • Automatic renewal: Your subscription renews automatically at the then-current price unless you cancel it at least 24 hours before the end of the current period. Your app store account is charged for renewal within 24 hours prior to the end of the current period.
  • You may cancel or manage your subscription at any time in your app store account settings. Cancellation takes effect at the end of the current billing period, and you keep access until then. Deleting the App does not cancel your subscription.
  • If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription.
  • We do not provide refunds for partial billing periods, except where required by law. Refunds for app store purchases are handled by Apple or Google under their policies.
  • Prices may change with notice. Continued use after a price change constitutes acceptance.

5. User Content and AI-Generated Content

  • You retain ownership of the content you submit (check-ins, notes, Pour It Out messages).
  • By submitting content, you grant us a non-exclusive, royalty-free license to use, display, and process that content to provide and improve the Service.
  • AI-generated responses are provided "as is." We do not claim ownership of AI outputs, but we grant you a limited license to use them personally.
  • You are solely responsible for the content you submit and how you use AI-generated responses.
  • You agree that we may generate aggregated and de-identified data from your use of the Service and may use and share that data for any lawful purpose, including business analytics, marketing, and advertising, as further described in our Privacy Policy.

6. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Harass, abuse, or harm others
  • Submit false or misleading information
  • Attempt to reverse engineer, decompile, or hack the Service
  • Use the Service to generate harmful, hateful, or illegal content
  • Share your account with others

7. Intellectual Property

  • The App, the Site, their design, code, content (except user-submitted content and licensed Bible translations), and trademarks are owned by us or our licensors.
  • Bible content is provided under license from third-party publishers and remains the property of those publishers. Scripture text in the App is licensed for your personal, non-commercial use only. You may not copy, extract, redistribute, or republish Scripture text from the App except as permitted by the applicable publisher's license.

8. Scripture Copyright Notices

Scripture quotations in the App are used by permission of their respective publishers. The following notices apply:

9. Third-Party Services

The Service depends on third-party providers for hosting, artificial intelligence processing, analytics, push notifications, Scripture content, and payments. We are not responsible for the availability, accuracy, or conduct of those providers, and the Service may be interrupted or degraded as a result of their outages or changes. Your use of the Service is also subject to any applicable terms imposed by your device platform and app store.

10. Apple App Store Terms

The following applies if you obtained the App from the Apple App Store. These Terms are between you and Mullins Worldwide LLC only, not with Apple. Apple is not responsible for the App or its content.

  • Apple has no obligation to furnish any maintenance or support services for the App, and is not responsible for addressing any claims relating to the App.
  • In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
  • Apple is not responsible for any third-party claim that the App or your use of it infringes intellectual property rights.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms of agreement when using the App.

11. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability to you for any claims arising out of or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if you have not paid anything).

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease.

14. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Washington, without regard to its conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved in the state or federal courts located in King County or Snohomish County, Washington.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App, the Site, or email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
